Certificate of Compliance

Last year we looked at the responsibilities of the homeowner when it comes to electrical compliance. Neglecting this crucial aspect of your home could land you in hot water. Insurance claims could be rejected and you will be held accountable. Now, lets look at how prospective buyers can protect themselves from a potentially expensive experience.

The seller is essentially liable for providing the certificate of compliance (CoC) prior to transfer and according to the law the property cannot be transferred without it. That being said, the person (electrician) issuing the actual certificate must be registered. This does sound all plain sailing, however, as with everything else there are loops and possibilities for things to go wrong, and sometimes horribly. Lets look at what preventative measures can be taken by you, the buyer.

Sometimes the CoC issued is completely fraudulent. Because there are no routine verification processes in place to determine the qualifications of the person who did the inspection. There’s no real way to determine that the CoC they issued was actually inspected against minimum legal standards. And that the electrical installations have been personally and adequately checked by suitably qualified electricians.

Once the house seller obtains an electrical CoC, even if there is a faulty installation, the responsibility for this defect then passes to the buyer on transfer. If the buyer then resells the house, and a genuinely qualified electrician is appointed, these faulty installations will be highlighted and the buyer would then unfortunately be liable for this expense.

The best way for buyers to protect themselves is to ensure that the property is fully inspected prior to purchase and that all inspections and certification are authentic and are carried out by genuinely qualified, unbiased professionals who are not bound to the estate agent or to the seller.
